TERMS AND CONDITIONS OF THE www.ChemiaSamochodowa24.pl ONLINE STORE

General

  1. The online store available in the www.chemiasamochodowa24.pl domain is run by MM Store Magdalena Tarnawska with its registered office in Krakow, run on the basis of an entry in the Central Registration and Information on Business kept by the Minister of Economy, NIP 8361686276, REGON 123000134.
  2. These Terms and Conditions define the terms and conditions of sale in the online store available at www.chemiasamochodowa24.pl
  3. The core business of MM Store Magdalena Tarnawska is the sale of automotive chemicals in direct sales and through an online store.
  4. Basic concepts:
    Seller – MM Store Magdalena Tarnawska
    Online store – a store operating in the domain www.chemiasamochodowa24.pl
    Buyer – the party making a purchase in the online store
  5. The buyer can make purchases in the online store via devices with access to the Internet, e-mail and an application that allows you to display websites.  
  6. The subject of sale may be all products available in the online store available in the domain www.chemiasamochodowa24.pl at the time of browsing it.
  7. All prices presented in the online store are given in Polish zlotys and are gross prices (including VAT). Prices do not include delivery costs.
  8. By filling in the purchase form available on the website, the buyer makes an offer to buy a specific product presented by the Store.

 

Ordering

  1. Orders can be placed through the online store 24 hours a day, by filling in the available order form. In addition, orders can be placed via e-mail sklep@mmstore.pl and by phone at 697692362.
  2. Placing orders is done by adding the selected product to the cart available on the online store's website, and then filling in the form, where you should indicate:
    a)      Address details necessary to complete the transaction
    b)      Details of the selected payment method
  3. After placing an order, the buyer receives an e-mail containing the details of the purchase.
  4. It is not necessary to register in the online shop to place an order.
  5. In order to place an order, it is necessary to consent to the processing of data necessary to process the order.
  6. Cancellation or modification of the order is possible until the shipment is completed. To do this, you should immediately contact the store via e-mail or phone. The above clause applies subject to the consumer's right to withdraw from the contract within 14 days from the date of delivery (delivery/collection) of the purchased goods.
  7. In the event of cancellation of the order, the Seller undertakes to return the funds to the Buyer's account within 7 days from the date of purchase.
  8. The delivery price of the order depends on the selected form of delivery.
  9. After selecting the form of delivery, the total value of the order is presented.
  10. There are four forms of payment available in the MM Store online store:

a) Bank transfer to the seller's account – the order is processed after the money is credited to the seller's account

Fulfillment

  1. The transaction is only processed if you provide true personal and contact details in the order form.  
  2. The Seller reserves the right to contact the Buyer if there is any inaccuracy in the data provided in the order form, preventing the execution of the order. If the contact is not made due to the fault of the Buyer within 7 days from the date of purchase, the Seller reserves the right to cancel the order.
  3. Orders are processed on working days from Monday to Friday from 8.00 a.m. to 4.00 p.m.
  4. Orders placed on non-working days are processed on the first working day following the day on which the order was placed.
  5. The Seller executes orders via:
    a) Polish Post Office
    b) Shenker courier company
    c) InPost companies
  6. Personal collection is carried out after prior arrangement of the collection date.
  7. The seller will make every effort to ensure that the implementation takes place in the shortest possible time, usually up to 2 business days. If the order cannot be completed within this time, the Seller reserves the right to contact the Buyer in order to arrange an approximate delivery date.
  8. If the order is not processed within 14 days from the date of placing the order, the Buyer may request a refund or exchange of the goods for another currently available product at the same price. The buyer may also agree to extend the order processing time.
  9. If the Buyer wishes to receive an invoice via the order form, he will receive it together with the delivered goods. The Seller reserves the right to issue an invoice without the Buyer's signature.
  10. Each time the Client can check the status of his order by contacting the Seller by phone.
  11. The Buyer should check the condition of the delivered goods in the presence of the Supplier. In the event of damage to the package, the Buyer should write a protocol in the presence of the Supplier and immediately send it to the store. If damage is noticed after the courier has departed, please contact the Supplier for the courier to re-arrive. The lack of a damage report may be a significant obstacle to claiming rights from the Online Store.

 

Complaints

  1. The buyer has the right to complain about the purchased goods.
  2. The complaint may be submitted in the form of an e-mail sent to the address sklep@mmstore.pl
  3. The complaint should contain the Buyer's precise contact details so that it is possible to contact the Buyer, the exact reason for the complaint and the Buyer's claims against the Seller.
  4. In the case of contracts concluded with Buyers having the status of consumers, complaints due to non-compliance of the Goods with the contract are considered in accordance with the Act of 27 July 2002 on specific conditions of consumer sales and on the amendment of the Civil Code.
  5. In the case of complaints filed by Buyers who are not consumers, the relevant provisions of the Civil Code in the field of warranty apply. In the event of an unjustified complaint, all costs related to the complaint will be covered by the Buyer who is not a consumer.
  6. The rights of the Consumer resulting from the non-conformity of the Goods with the contract or the Buyer who is not a Consumer under the warranty for defects do not limit the rights of the Buyer resulting from the guarantee granted by the guarantor – on the terms indicated in the warranty document.

 

Withdrawal from the contract

  1. The Buyer with the status of a Consumer has the right to withdraw from the agreement without giving a reason within 14 days from the date of handing over the purchased goods.
  2. In order to withdraw from the agreement, the Buyer should send an appropriate statement to the Store's address or via e-mail to the address of sklep@mmstore.pl
  3. In the event of effective withdrawal from the contract by the consumer, he is obliged to return the goods at his own expense, immediately, but not later than 14 days from the date of withdrawal from the contract. To meet this deadline, it is sufficient to send the goods to the Seller's address before its expiry.
  4. The money will be returned by the Seller to the Buyer's bank account, by postal order or in person at the Store's headquarters, depending on the Buyer's will.
  5. In the case of other Buyers who do not have the status of a consumer, the rules and deadlines for withdrawal from the agreement are regulated by the provisions of the Civil Code.

 

Registration and protection of personal data

  1. When filling in the order form, the buyer is obliged to provide data identical to the actual state.
  2. By filling in the order form, the Buyer agrees to the processing of his data by the Seller for the purpose of completing the order and to adding the data to the database of the Seller, who is also the data administrator, in accordance with the provisions of the Act of 29 August 1997 on the protection of personal data.
  3. When placing an order, the Buyer has the right to consent to the use of their data for marketing purposes. This consent is not mandatory.
  4. The Buyer's data entered into the Seller's database are not transferred to entities unrelated to the execution of the order.
  5. In accordance with the above-mentioned Act, the Buyer has the right to inspect their personal data, the possibility of correcting and deleting them. The Seller provides each Buyer with the right to control the processing of data in accordance with Article 32 of the Personal Data Protection Act.

Final provisions

  1. These Terms and Conditions do not exclude or limit any rights of the Buyer who is a consumer, which he is entitled to under the mandatory provisions of law. In the event of a conflict between the provisions of these Terms and Conditions and the mandatory provisions of law granting rights to consumers, these provisions shall prevail.
  2. In matters not covered by these Terms and Conditions, the provisions of generally applicable law shall apply, including in particular the provisions of the Civil Code, the Act of 2 March 2000 on the Protection of Certain Consumer Rights and Liability for Damage Caused by a Dangerous Product and the Act of 27 July 2002 on Specific Terms and Conditions of Consumer Sales and on Amendments to the Civil Code.
  3. The Store reserves the right to change these Terms and Conditions. An amendment to the Terms and Conditions becomes effective when the Buyers become familiar with the change. Orders placed by Buyers before the change of the Terms and Conditions are carried out in accordance with the existing provisions of the Terms and Conditions.
